Terms of Service
These Terms of Service ("Terms") are a binding agreement between you and Miso ("Miso", "we", "us") and govern your use of the Miso mobile application (the "App"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old (or the equivalent minimum age in your jurisdiction) to use the App. By using the App you represent that you meet this requirement. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Your account
You are responsible for the information you provide when registering and for keeping your account credentials secure. You are responsible for all activity that occurs under your account. Notify us promptly if you believe your account has been used without your permission. We may suspend or terminate accounts that violate these Terms.
3. Your content
The App lets you upload photos, write captions and comments, record walks, and share information about you and your dog ("Your Content"). You retain ownership of Your Content. By submitting Your Content to the App you grant Miso a worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, display, and adapt Your Content solely for the purpose of operating, improving, and providing the App to you and to other users in accordance with the visibility settings you choose. This licence ends when you delete the content from your account, except that we may retain server backups for a reasonable period.
You represent that you have all rights necessary to submit Your Content and that Your Content does not infringe the rights of any third party.
4. Acceptable use
You agree not to:
- Post content that is unlawful, harassing, defamatory, obscene, hateful, or that infringes the rights of others.
- Post photos or information of other people, including children, without their consent (or, for minors, the consent of a parent or guardian).
- Impersonate another person, account, or entity.
- Use the App to send spam, scams, or unsolicited promotional content.
- Attempt to gain unauthorized access to the App or its underlying systems, probe for vulnerabilities, or interfere with the operation of the App for other users.
- Scrape, copy, or redistribute content belonging to other users beyond what the App's features expressly allow.
- Use the App to track or surveil another person without their knowledge and consent.
We may remove content and suspend or terminate accounts that violate this section. User reports of objectionable content are triaged within 24 hours; see our Support page and email [email protected] to escalate.
5. Health, fitness, and GPS disclaimer
The App is not a medical device and is not a substitute for professional veterinary or medical advice. AI-generated suggestions about your dog's health, exercise, or weight are informational only and may be inaccurate. Always consult a licensed veterinarian for decisions about your dog's care, and a qualified professional for decisions about your own health. Calorie estimates, distance calculations, and heart rate readings produced by the App are approximate and may not reflect actual values.
The App's mapping and location features rely on GPS signals from your device and on publicly sourced map data. Routes shown in the App are not turn-by-turn directions and may be incomplete or inaccurate. Do not rely on the App for navigation in unfamiliar areas, in conditions of low visibility, or in situations where an error in location data could be hazardous. Be aware of your surroundings when walking.
6. Privacy
Our handling of your information is described in our Privacy Policy, also available within the App. By using the App you agree to that handling.
7. Third-party services
The App relies on third-party services (including Supabase, Anthropic, Apple, Google, Facebook, Expo, and OpenStreetMap contributors) to function. Your use of those services may be governed by their own terms. We are not responsible for the availability, content, or practices of third-party services.
8. Termination
You may stop using the App at any time and may delete your account from within the App's Settings. We may suspend or terminate your access to the App, with or without notice, if we reasonably believe you have violated these Terms or if continuing to provide the App to you would expose us to legal risk. Sections of these Terms that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and dispute resolution) will survive.
9. Disclaimers
The App is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We do not warrant that the App will be free of errors, that defects will be corrected, or that the App or the servers that make it available are free of harmful components. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the foregoing exclusions may not apply to you.
10. Limitation of liability
To the maximum extent permitted by law, Miso and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the App. Our aggregate liability for direct damages arising out of or in connection with these Terms or the App will not exceed the greater of (a) the amount you have paid us in the twelve months preceding the event giving rise to the liability, or (b) USD 50.
11. Indemnification
You agree to indemnify and hold harmless Miso from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your use of the App in violation of these Terms, or your violation of any law or third-party right.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date above and, for material changes, post an in-app notice. Continued use of the App after a change indicates acceptance of the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the App will be brought exclusively in the courts of Vancouver, British Columbia, and you consent to the personal jurisdiction of those courts.
14. Apple App Store terms
If you obtained the App through the Apple App Store, the following additional terms apply: these Terms are between you and Miso, not Apple. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing claims by you or a third party relating to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
